We are registered in Louisiana, United States, with our registered office at 2210 Octavia St, New Orleans, LA 70115. By accessing our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.

We reserve the right to update these Terms at any time. Continued use of our Services following any update constitutes your acceptance of the revised Terms. The Site is intended for users aged 18 or older. Persons under 18 are not permitted to use our Services.

All content on our Site and delivered through our Services — including watchlists, newsletters, technical analysis, bot messages, PDF reports, graphics, and branding — is the proprietary property of Trendsetters Trading, LLC and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our content solely for your personal, non-commercial use as a subscriber. You may not copy, reproduce, redistribute, resell, or commercially exploit any content without our express written permission.

By using our Services, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into these Terms, will not use our Services for any illegal or unauthorized purpose, and that your use will comply with all applicable laws and regulations.

Access to our Services requires a recurring monthly subscription. Subscription fees are billed in U.S. dollars. We accept the following payment methods: major credit and debit cards, Apple Pay, Google Pay, Shop Pay, PayPal, Zelle, and Venmo. Payments processed through Shopify Checkout may vary in available methods.

Subscriptions are processed through Seal Subscriptions via Shopify. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. We reserve the right to update pricing at any time with notice to active subscribers.

All subscription purchases are non-refundable. You may cancel your subscription at any time by logging into your account or contacting us directly. Cancellations take effect at the end of the current billing period — you retain access through that period.

As a user of our Services, you agree not to:

• Redistribute, resell, or share our content with non-subscribers without written permission.
• Repost or republish content delivered via our Discord bot or Whop dashboard outside of authorized channels.
• Use our content to compete with us or build a competing service.
• Use automated tools, bots, or scripts to access or scrape our Services.
• Attempt to reverse-engineer, decompile, or extract our methodologies, algorithms, or analytical frameworks.
• Harass, abuse, or threaten our team, other subscribers, or any individual connected to our Services.
• Misrepresent our content as your own original analysis or advice.
• Use our Services in violation of any applicable laws or regulations.

Our weekly PDFs, daily watchlists, intraday analysis, and all other content delivered through our Services are proprietary. White label subscribers are granted a separate license to distribute our content under their branding per the terms of their white label agreement.

Unauthorized redistribution of our content in any form — including screenshots, copy-paste, forwarding, or reposting — is a violation of these Terms and our intellectual property rights. We reserve the right to terminate access for any subscriber found redistributing our content without authorization.

Trendsetters Trading, LLC may utilize artificial intelligence tools to assist in content creation, formatting, delivery automation, and analysis workflow. All AI-assisted content is reviewed by human analysts prior to distribution and is subject to the same terms, disclaimers, and limitations as all other content we produce.

The use of AI tools does not alter the educational nature of our content. AI-assisted outputs are not financial advice and do not represent guarantees of market performance. You acknowledge that AI-generated content may contain errors or limitations inherent to the technology.

Our Services are delivered in part through third-party platforms including Discord, Whop, and Shopify. Your use of these platforms is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or downtime of these third-party services.

Payment processing is handled by Shopify and Seal Subscriptions. We do not store your payment card information directly. Please refer to Shopify's privacy policy at shopify.com/legal/privacy for details on payment data handling.

Our Services are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no representations about the accuracy, completeness, or timeliness of our content.

We are not liable for any errors or omissions in our content, any interruptions or delays in service, any losses incurred from trading or investment decisions made in connection with our content, or any unauthorized access to our systems.

In no event shall Trendsetters Trading, LLC, its directors, employees, or agents be liable to you for any direct, indirect, consequential, incidental, special, or punitive damages — including lost profits, lost data, or financial losses — arising from your use of our Services, even if we have been advised of the possibility of such damages.

Our maximum liability to you for any cause shall not exceed the amount you paid us in the one-month period prior to the cause of action arising.

You agree to defend, indemnify, and hold harmless Trendsetters Trading, LLC, including its subsidiaries, affiliates, officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand — including reasonable attorneys' fees — arising out of: (1) your use of our Services; (2) breach of these Terms; (3) any breach of your representations and warranties; (4) your violation of the rights of a third party, including intellectual property rights; or (5) any harmful act toward any other user connected via our Services.

We maintain certain data you transmit to our Services for the purpose of managing performance and your account. Although we perform routine backups, you are solely responsible for all data you transmit or that relates to any activity you undertake using our Services. We shall have no liability to you for any loss or corruption of such data, and you waive any right of action against us arising from any such loss or corruption.

Visiting our Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications and agree that all agreements, notices, and disclosures we provide electronically satisfy any legal requirement that such communication be in writing. These Terms shall be governed by the laws of the State of Louisiana, United States. Any disputes arising in connection with these Terms shall be resolved exclusively in the state or federal courts located in Orleans Parish, Louisiana, and you irrevocably consent to that jurisdiction.

No claim or action arising from use of our Services may be commenced more than one (1) year after the cause of action arose.

We reserve the right to terminate or suspend your access to our Services at any time, without notice, for any violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use our Services ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.
